Distributing the estate of a deceased Muslim according to Sharīʿa is a fundamental obligation and an act of obedience to Allah (). The specific shares of inheritance have been divinely ordained in the Qur’an, and no human being has the right to alter or withhold them. Therefore, no one should feel ashamed or hesitant to ask for their rightful share, and it is a serious wrongdoing to deny anyone their inheritance. The Prophet Muhammad () warned, “Whoever deprives someone of his inheritance, Allah will deprive him of Paradise” (Ibn Mājah). It is also essential that inheritance is distributed promptly after death, without unnecessary delay, to ensure justice is upheld and the rights of heirs are fulfilled in accordance with Sharīʿa.
Please note that harām wealth obtained through forbidden means such as theft, fraud, or deception cannot lawfully be transferred to heirs. All the major Sunni madhāhib agree on this principle. Click here for more details.
شریعتِ مطہرہ کے مطابق کسی مرحوم مسلمان کے ترکہ کی تقسیم ایک بنیادی شرعی فریضہ اور اللہ سبحانہ و تعالیٰ کی اطاعت کا تقاضا ہے۔ وراثت کے مخصوص حصے قرآن کریم میں براہِ راست الہامی طور پر مقرر کیے گئے ہیں، اور کسی انسان کو ان حصوں میں رد و بدل یا انہیں روکنے کا کوئی اختیار حاصل نہیں ہے۔ لہٰذا کسی شخص کو اپنے شرعی حق کے مطالبے میں شرمندگی یا ہچکچاہٹ محسوس نہیں کرنی چاہیے، اور کسی وارث کو اس کے حقِ وراثت سے محروم کرنا ایک سنگین شرعی جرم ہے۔ نبی کریم ﷺ نے فرمایا: “جس نے کسی کو اُس کا ورثہ نہ دیا، اللہ تعالیٰ اسے جنت سے محروم کر دے گا۔” (ابن ماجہ)۔ اسی طرح یہ امر بھی نہایت اہم ہے کہ وفات کے فوراً بعد بلا کسی غیر ضروری تاخیر کے ترکہ کی تقسیم عمل میں لائی جائے، تاکہ عدل و انصاف کا قیام ممکن ہو اور ورثاء کے حقوق شریعت کے مطابق ادا کیے جا سکیں۔
براہِ کرم یاد رکھیں کہ حرام مال، جو چوری، دھوکہ دہی، فریب یا دیگر ناجائز ذرائع سے حاصل کیا گیا ہو، شرعی طور پر ورثاء کو منتقل نہیں کیا جا سکتا۔ تمام بڑے سُنّی مذاہب اس بات پر متفق ہیں کہ ایسے حرام مال کی وراثت جائز نہیں۔ مزید معلومات کے لیے یہاں کلک کریں۔
The application process allows you to enter potential heirs up to three generations above and three generations below the deceased. It is intuitive, in that, if you leave the number of sons blank, it will prompt you to enter grandsons; if no grandsons are entered, it will prompt you for great-grandsons. Similarly for other heirs. You can also select which Islamic school of jurisprudence (madhhab) you wish to apply to your inheritance calculation.
